Peaceful demonstration is not misconduct: court

While quashing the charge memo issued to two State Bank of India (SBI) officers alleging misconduct for holding a lunch hour demonstration in August last year, the Madras High Court has held that a mere peaceful demonstration, per se, inside the campus, cannot be understood as a mark of misconduct under the rules.

A Division Bench comprising Justices Chitra Venkataraman and K.B.K.Vasuki passed the common judgment on appeals filed by two officers of the bank against a single Judge’s order of February 8 this year.

The two, D.Thomas Franco Rajendra Dev, Deputy Manager, SBI, RBU, LHO, Chennai and D.Suresh Kumar, Chief Manager, RBU, LHO, Chennai, were the general secretary and elected president of the All India State Bank of India Officers’ Association respectively. The association held a lunch hour demonstration on August 28 last year in front of the local head office and in all the administrative offices of the bank. Members, including the two officers, participated.

Sexual offenders in office stand to lose job, promotion

You could risk losing at least 10% of your salary every month for a year, promotions, withdrawal of privileges and perks or even face termination of service if found guilty of sexually harassing a woman at your workplace. These are part of the new rules under the Sexual Harassment at Workplace(Prevention, Prohibition and Redressal) that was passed by Parliament recently. The rules empower the complaints committee to restrict the perpetrator's entry from the workplace if the guilty happens to be an outsider. The panel can also impose a fine of Rs 500, or 5% of the woman's salary in case of a false or malicious complaint.

These provisions are included in new rules that have been drafted by the ministry of women and child development and sent to the law ministry for their opinion. The provisions are likely to be notified by end-August.
A complaints committee, established under the law, will be empowered to recommend and impose a written apology, censure, withhold promotions, pay hikes or increments, entitlements and privileges, impose termination of service in case where they find a case of sexual harassment. The committee can also revoke, suspend any licence or registration in cases like a doctor or a lawyer's licence.

New Rules of filing Tax returns

The tax authorities have introduced several new guidelines for filing returns this year. Find out how these changes are likely to impact you.

First they made it compulsory for businesses to e-file their tax returns. Then they made it mandatory for taxpayers with incomes of over 10 lakh to take the online route. This year, the income tax authorities have cast a wider net and made e-filing compulsory if your taxable income is above 5 lakh a year.

The lowered threshold represents one of the key changes in the tax filing rules this year. Some of these are mere tweaks, such as mentioning your bank's IFSC number, instead of the MICR code, in the return. However, some of these variations are tectonic, such as the mandatory e-filing for incomes above 5 lakh a year. In the following pages, ET Wealth explains the new rules and how they will affect the way you file your tax return this year.

EXEMPTION FROM FILING ITR (INCOME TAX RETURN) NOT EXTENDED THIS ASSESSMENT YEAR 2013-14 – CBDT
