Vide Para 2.2 of Postal directorate letter dated 24.07.2020 regarding scrutiny of various union's bylaw/Constitution, department unilaterally mandated all unions to change word "union" in their bylaw/ constitution with word "association".
It may be to snatch away our trade Union rights from all unions/associations why because labour act and industrial dispute act 1947 are our main shield to protect our employees right and to make strikes are legal.
If word union is replaced with word association in all places of bylaw/constitution copies then as associations, we may not approach labour commission for our disputes with administration and strikes also might become illegal to take stringent action against striking employees.
Important amendments if any in any union's constitution is possible only with the approval of that Union members during their all india conferences and department cannot force any union to change any word of our constitutions without any new law enacted recently. Still the same CCS RSA rules 1993 applicable to all unions then why now department mandating to replace word union with association now is million dollar question.
So we must be well aware against future consequences before amending any changes in our union's bylaw/constitutions. I request all union's portfolio leaders to look into this.
