An – Important CAT Decision


Abnormal delay in issuing a charge-sheet to an employee for his omissions and commissions leads to quashing of charge-sheet and also return of recovered money, if any amount is recovered from the charge-sheeted employee

Facts: While the Applicant was working as Accountant with effect from 21.5.1996 and BCR with effect from 1.7.2007, he was issued with a charge-memo under rule 16 of CCS (CCA) Rules vide Memo, dated 11.12.2008 for a matter which related to October, 1997, i.e. more than 11 years old. A recovery of Rs1,94,791 was to be recovered as per the order of SPOs, Sitapur, dated 27.03.2009. His appeals were rejected. Hence he filed this OA for setting aside his punishment.

Negative List of Services not liable for service tax :Union budget 2012 is reproduced below. There is service tax exemption announced for Speed post and Express parcel post in the first Negative list itself. 
1. Services by Government or a local authority excluding the following services to the extent they are not covered elsewhere:(i) services by the Department of Posts by way of speed post, express parcel post, life insurance and agency services provided to a person other than Government;

Indian Post Office Act, 1898 section 4:

a) letters sent by a private friend in his way, journey or travel, to be delivered by him to the person whom they are directed, without hire, reward or other profit or advantages for receiving, carrying or delivering them;
b) letters solely concerning the affairs of the sender or receiver thereof, sent by a messenger on purpose; and
c) letters solely concerning goods or property sent either by sea or by land to be delivered with the goods or property which the letters concern without hire, reward or other profit or advantages for receiving, carrying or delivering them;

Provided that nothing in this section shall authorize any person to make a collection of letters except as aforesaid for the purpose of sending them otherwise than by post.
